“Australia’s Best Worst Shed” Competition

Participation in the Promotion is deemed to be an acceptance of these Terms and Conditions. 

Promoter

The Promotion is conducted by FBHS (Aust) Pty Ltd, trading as Fair Dinkum Builds, located at 1051 Nudgee Road, Banyo QLD 4014 Australia.

Sponsors

This Promotion is financially sponsored by several major suppliers of Fair Dinkum Builds. These sponsors are not responsible for the administration of the Promotion. Sponsors are:

Gold level: Stramit Corporation, Taurean Door Systems

Silver level: Fletcher Insulation, Stoddart

Bronze level: Bremick Fasteners, Ampelite Australia, Advance Metal Industries Australia, Larnec Doors and Systems, Chamberlain Group LLC (T/A Merlin and Grifco)

Prize

The total prize pool value is $70,000 (inc. GST), split into 3 Major Prizes and 10 Minor Prizes as outlined below. All values listed are retail values.

Major Prizes:

1st – $30,000 (inc. GST) Fair Dinkum Builds shed

2nd – $20,000 (inc. GST) Fair Dinkum Builds shed

3rd – $10,000 (inc. GST) Fair Dinkum Builds shed

Each Major Prize is one (1) Fair Dinkum Builds shed per Major Prize Winner with a retail value of up to the individual amounts listed above. Each Major Prize includes the material cost of the shed, installation costs, concrete slab and delivery costs. If the Major Prize Winner’s chosen shed attracts a higher retail value than their Major Prize amount, Fair Dinkum Builds will supply the indicated amount towards the total shed cost, excluding the items specified as Exclusions in these Terms and Conditions. Any remaining amount must be paid by the Major Prize Winner. If the Major Prize Winner’s chosen shed materials, installation, slab and delivery totals less than the individual retail amounts listed above, the remaining amount will be forfeit and will not be paid out in cash or redeemable for any other product.

Exclusions:

All major prizes exclude: Demolition of any previous shed or structure, asbestos removal and/or any major site preparation including earthworks or structural work.

Minor Prizes:

10 x $1,000 Prezzee eGift Vouchers.

1 awarded each week of the Promotional Period. Prizes will be issued no later than seven (7) working days following the announcement of the winner of that minor prize.

Minor prizes will be delivered electronically to the Minor Prize Winners via the email address supplied on the Entry Form.

Eligible Entrants are eligible to win a maximum of one prize from the Major Prize pool and a maximum of one prize from the Minor Prize pool.

Promotional Period

State Date and Time: Tuesday 26 October 2021 at 9:00am (Australian Eastern Standard Time)
End Date and Time: Friday, 21 Jan, 2022, 1:00pm (Australian Eastern Standard Time)

Eligible Entrant

Participation in the Promotion is open to Australian residents only aged 18 years or over. Employees of the Promoter or parent company Stramit Corporation Pty Limited ABN 57 005 010 195, immediate family members of any employee of the Promoter or parent company, and employees of the Sponsors of the promotion are not eligible to participate in the Promotion.

To be eligible to win one of the Major Prizes, Eligible Entrants must own the nominated “best worst shed” and the property on which the new shed is intended to be built or have authority to organise a new shed build on behalf of the property owner or organisation. Entrants may not nominate a “best worst shed” by completing an Entry Form on behalf of another person or entity without express consent. If completing an entry on behalf of a not-for-profit charity, company, business, organisation, body corporate, group, trade customer or reseller or distributor of products, Eligible Entrants acknowledge that if they are the winner or a Major or Minor Prize they agree to hand over the full value of the Prize/s to the entity nominated on their Entry Form.

How to Participate in the Promotion

Between Tuesday, 26 October 2021 at 9:00am and Monday, 10 January 2022 at 1:00pm Australian Eastern Standard Time (Entry Period), an Eligible Entrant must:

• go to the Redemption Website and complete the online form for the Promotion (Entry Form);
• provide in 100 words or less a text description of why their shed is Australia’s “best worst shed” and why they deserve to win a new shed more than anyone else
• submit at least one photo and/or video of their “Best Worst Shed” entry; and
• have otherwise complied with these Terms and Conditions.

To be eligible for a Major Prize, Eligible Entrants must:

• complete all the above requirements; and
• receive enough votes to qualify as one of the top ten entries, as outlined below.

Entries may be edited by the Promoter for clarity. Entries containing profanity, spam, graphic or explicit adult content, hate speech, that incite violence or criminal behaviour, are cruel and insensitive or that promote a negative image of the Promoter, the Promotion’s sponsors, or any individuals or entities connected with the Promoter will not be accepted as part of this Promotion.

Judges

Major Prizes:

Throughout the Promotional Period, a digital voting system will be open for members of the public to vote for their favourite “Best Worst Shed” entry. This voting system will be run via third-party software accessed via fairdinkumbuilds.com.au/winashed. One vote per unique IP address can be recorded each day.

At the end of the competition Entry Period (10th January, 2022, 1:00pm AEST), the online voting system will close. The ten entries with the highest number of votes recorded during the competition entry period will form the top 10 entries and be eligible for the Major Prize judging. Of the top ten, three entries will be selected as winners by the Judge. The judge of the Major Prize Winners is a panel of representatives from Fair Dinkum Builds and all gold and silver level sponsors of the Promotion (Major Prize Judge). Entries will be judged according to the following criteria:

1. Creativity
2. Entertainment value
3. Quality of photos and/or videos supplied
4. Suitability of the shed and property entered to have a new shed built within the requirements of the Promotion (e.g.
   1. the property is owned by the Eligible Entrant;
   2. adequate space is available to build;
   3. any required building permits are able to be obtained;
   4. the required timeframes set out in this document can be met;
   5. the replacement shed is to be of a size, quality and style able to be provided by Fair Dinkum Builds; and,
   6. the Major Prize Winners are able and willing to cover any excess costs as outlined in the “Prize” section above.)

The three Major Prize winners are not determined by the total number of votes received.

Minor Prizes:

Winners of the weekly Minor Prizes will be selected by the Judge (Minor Prize Judge), a team member from Next Thursday, (a Brisbane-based advertising agency) each week according to the following criteria:

1. Creativity
2. Entertainment value
3. Quality of photos and/or videos supplied

Winners will be selected from the entire pool of entries including those received in prior weeks. These winners are not determined by the total number of votes received and do not automatically qualify for a position in the top ten.

There are three Major Prizes and ten Minor Prizes to be won. The Promotion is a game of skill.

Entry Limits

Multiple entries by the same entrant in the Promotion is permitted.  An Eligible Entrant will receive one entry for each unique Entry Form and photo/video submission. Duplicated entries (the same shed) will not be valid.

Prize Draw

The competition judging will occur as per the Schedule of prize judging table, outlined below. Judging of the Major Prizes will occur at the Crestmead office of the Promoter at 57-71 Platinum St, Crestmead, QLD, 4132.

Judging of the Minor Prizes will occur at the offices of advertising agency Next Thursday - WeWork on Level 6, Riverside Centre, 123 Eagle St, Brisbane, QLD, 4000.

Winner Announcement

The winner of the Major Prizes will be announced on or before 21st January 2022 on the website at fairdinkumbuilds.com.au and via the Fair Dinkum Builds Facebook channel. The winners will be contacted by phone and in writing via email using the contact details provided on the Entry Form.

The winners of each Minor Prize will be announced as per the schedule for prize judging. Winners will be published on the Fair Dinkum Builds Facebook page and contacted by phone and in writing via email using the contact details provided on the Entry Form.

The Major Prize Winners will be asked to contact the Promotor to arrange design and installation of the Prize from the Fair Dinkum Builds franchisee or authorised Fair Dinkum Sheds distributor nominated by the Promoter. The Major Prizes must be accepted by the winners by 22 March 2022.

Complete installation of the Major Prizes needs to take place no later than 30 June 2022 with any outstanding payments due in excess of the prize value also made prior to installation. If any Major Prize installation is not arranged by this deadline, that Prize will be forfeited by the winner. 

The Minor Prizes will be electronically delivered to the email address provided by the winner on their online form within seven (7) business days from the date that winner is announced. The Promoter does not accept responsibility for any errors or misprints of the email address by the Eligible Entrant.

General Terms

1. The Prize is not transferable, exchangeable or redeemable for cash.  Prize values are in Australian dollars. 
   
   
2. If a Prize is unavailable due to circumstances beyond the control of the Promoter, the Promotor reserves the right to substitute the Prize with a prize of equal value (the Promotor will first make reasonable attempts to reach agreement with the winner on the substitute prize).
   
   
3. This Promotion is open to individuals, not for profit charities, companies, businesses, organisations, body corporate bodies, groups, trade customers or resellers or distributors of products or anyone acting on their behalf. 
   
   
4. The Promotional Period may be extended at the Promoter’s sole discretion. 
   
   
5. The Promoter is not liable for any costs incurred when accessing Instagram or Facebook or any website, or for any failure or service interruption of Instagram, Facebook or a website at any time. 
   
   
6. The Promoter reserves the right, at any time, to verify the validity of claims and Eligible Entrants (including an Eligible Entrant’s identity, age, place of residence and validity of the shed entered into the competition). The promoter reserves the right, in its sole discretion, to disqualify any Eligible Entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. 
   
   
7. The Promoter’s and Judge’s decision is final and no correspondence will be entered into. 
   
   
8. An Eligible Entrant receives and uses the Prize at their own risk.
   
   
9. The Major Prizes are supplied by a Franchise business of Fair Dinkum Builds or an authorised distributor of Fair Dinkum Sheds and are subject to the terms and conditions of the franchisee/distributor. The Promoter makes no representation or warranty as to the quality of services or goods provided by independent franchises/distributors.
   
   
10. The Minor Prizes are supplied by an independent 3rd party supplier and are subject to the terms and conditions of the 3rd party supplier, found at https://www.prezzee.com.au/doc/terms-of-service/. The Promoter makes no representation or warranty as to the quality of services or goods provided by 3rd party suppliers of goods and services forming part of the Prize. 
    
    
11. The Eligible Entrant acknowledges and agrees that the Promoter gives no representation, no advice, no warranty, no undertaking, no promise and no forecast in relation to the Prize or its fitness or suitability for any purpose.
    
    
12. The Prizes cannot be returned for cash or substituted once selected by the Eligible Entrant. 
    
    
13. By entering the Promotion, the Eligible Entrant consents to the Promoter sending future marketing materials to the Eligible Entrant including by electronic messages. See our Privacy Policy for further information.
    
    
14. Eligible Entrants consent to the Promoter using their name, their resident state or region, likeness, image and submitted images and/or photos (including photograph, film and recording of the same) in any media for an unlimited period, without remuneration, for the purpose of promoting this Promotion (including any outcome), the Promotor or any products manufactured, distributed or supplied by the Promoter.
    
    
15. To the maximum extent permitted by law, the Promoter and its officers, employees, agents, suppliers and any related bodies corporate of the Promoter exclude all liability for any claim, liability, loss or damage (including personal injury, death, property damage, and any liability for loss of profit, loss of revenue, loss of use, loss of opportunity and any kind of indirect, special or consequential loss or damage) which is suffered or sustained by any individual including any Eligible Entrant in connection with the Promotion or the use of the Prize, including without limitation as a result of receiving the Prize, any tax liability, any technical difficulties or equipment malfunction (whether or not under the Promoter's control), any Prize that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Promoter, any act or omission (whether negligent or not) of the Promoter or its suppliers, contractors or agents or any person associated with any of them or any theft, unauthorised access or third party interference. 
    
    
16. If for any reason this Promotion is not capable of running as planned (including by reason of, but not limited to, technical failures, unauthorised intervention, fraud or any other causes beyond the control of the Promoter) which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion.
    
    
17. Eligible Entrants must not reproduce, copy or post any images that breach the intellectual property rights of any third party.  It is the sole responsibility of the Eligible Entrant to ensure that their entry in the Promotion does not breach the intellectual property rights of any third party.  You warrant to the Promotor that your entry does not breach the intellectual property rights of any third party. 
    
    
18. The Promoter and each Eligible Entrant:
    (a) release Instagram/Facebook from any liability in connection with the Promotion; and
    (b) acknowledge that the Promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram/Facebook.
